1. Nature of the Service
The COA is a care coordination, document management, and decision-support platform operated by Chosen Ones Alliance, LLC. The COA is designed to help caregivers organize information, understand documents, and prepare for care-related decisions.
The COA does not provide medical advice, diagnosis, or treatment. Nothing on this platform, including content generated by Essei, The COA's AI assistant, constitutes medical advice or a substitute for the judgment of a licensed healthcare professional. Essei is a decision-support tool. It surfaces information to help you think. All care decisions remain the sole responsibility of caregivers and licensed professionals.
2. Eligibility
You must be at least 18 years of age to create an account. By creating an account you represent that you are at least 18 years old and have the legal authority to accept these terms on behalf of yourself and any family members whose information you manage through the platform.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@thecoa.io if you become aware of any unauthorized access to your account. Chosen Ones Alliance, LLC is not liable for any loss or damage arising from unauthorized account access resulting from your failure to protect your credentials.
4. Data Use and Ownership
You retain ownership of all information you provide to The COA. You grant Chosen Ones Alliance, LLC a limited, non-exclusive license to process, store, and analyze your information solely for the purpose of operating and improving the platform and delivering services to you. We do not claim ownership of your data. You may export or delete your data at any time through your account settings.
5. Advertising and Data Sales
The COA does not sell personal data, health data, or care records. We do not share your data with advertisers or advertising networks. We do not permit third parties to use your data for targeted advertising. The COA is funded by subscriptions, not by the monetization of your family's information.
6. Acceptable Use
You agree not to use The COA to upload, store, or transmit content that is unlawful, harmful, or violates the rights of others. You agree not to attempt to reverse engineer, disrupt, or gain unauthorized access to any part of the platform or its infrastructure.
7. Termination
You may close your account at any time through Profile Settings. Upon account closure, your personally identifiable information is deleted. Medical and care records are retained for six years as required by applicable law and then permanently removed. Audit and consent logs are retained permanently to meet compliance requirements. Chosen Ones Alliance, LLC reserves the right to suspend or terminate accounts that violate these terms.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Chosen Ones Alliance, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. In no event shall our total liability to you exceed the greater of the amount you paid to Chosen Ones Alliance, LLC in the twelve months preceding the claim or one hundred dollars ($100.00).
9. Disclaimer of Warranties
The COA is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components.
10. Dispute Resolution
Any dispute arising out of or relating to these terms or your use of The COA shall be resolved by binding arbitration administered under the rules of the American Arbitration Association. Arbitration shall take place in North Carolina. You waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.
11. Governing Law
These terms are governed by the laws of the State of North Carolina without regard to its conflict of law provisions.
12. Changes to These Terms
We may update these terms from time to time. When we do, we will increment the consent version and prompt you to review and re-accept before continuing to use the platform. Continued use after acceptance of updated terms constitutes agreement to the revised terms.
